Tripkii is NOT:

  • A travel agency or tour operator
  • A direct provider of travel services (flights, hotels, transportation)
  • An insurance provider
  • Responsible for the actual delivery of travel services

We act solely as an intermediary platform connecting you with third-party travel service providers.

3. ELIGIBILITY AND ACCOUNT REGISTRATION

3.1 Age Requirements

You must be at least 18 years old to use our Service. By using Tripkii, you represent and warrant that you are at least 18 years of age.

3.2 Account Information

When creating an itinerary or using our Service, you agree to:

  • Provide accurate, current, and complete information
  • Maintain and promptly update your information
  • Keep your account access secure
  • Accept responsibility for all activities under your account
  • Immediately notify us of any unauthorized use

3.3 Account Restrictions

We reserve the right to:

  • Refuse service to anyone for any reason at any time

You are responsible for:

  • Verifying visa, passport, and health requirements for your destinations
  • Confirming all booking details before finalizing reservations
  • Understanding cancellation and refund policies of third-party providers

5. BOOKINGS AND THIRD-PARTY SERVICES

5.1 Third-Party Bookings

When you make bookings through our platform:

  • You are entering into a contract directly with the third-party provider
  • The third-party's terms and conditions apply to your booking
  • Payment is processed by or through the third-party provider
  • We earn commissions from these bookings

5.2 Our Role

Tripkii:

  • Facilitates connections between users and travel service providers
  • Does not guarantee the availability, quality, or pricing of third-party services
  • Is not responsible for changes, cancellations, or issues with third-party services
  • Does not verify all information provided by third-party providers

5.3 Pricing and Availability

  • Prices displayed are provided by third-party suppliers and may change
  • Availability is subject to confirmation by the service provider
  • Additional fees, taxes, or charges may apply
  • Currency conversions are estimates only

6. CANCELLATIONS AND REFUNDS

6.1 Third-Party Provider Policies

Cancellations and refunds are governed by the policies of the specific third-party provider. You must review and understand these policies before booking.

6.2 Our Assistance

While we are not responsible for refunds, we may attempt to assist you in communicating with third-party providers regarding cancellations or modifications, but we cannot guarantee any specific outcome.

6.3 Service Fees

Any service fees charged by Tripkii (if applicable) are non-refundable unless otherwise stated.

7. INTELLECTUAL PROPERTY

7.1 Our Content

All content on Tripkii, including but not limited to:

  • Website design and layout
  • Text, graphics, logos, and images
  • Software and code
  • AI-generated suggestions

is owned by Tripkii or our licensors and is protected by intellectual property laws.

7.2 Your License to Use

We grant you a limited, non-exclusive, non-transferable license to access and use the Service for personal, non-commercial purposes.

7.3 User-Generated Content

By submitting content to our Service, you:

  • Grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, and display your content
  • Represent that you own or have rights to the content
  • Agree that your content does not violate any third-party rights

7.4 Restrictions

You may not:

  • Copy, modify, or distribute our content without permission

  • That travel plans will proceed without disruption

8.3 Third-Party Content

We are not responsible for content, policies, or practices of third-party websites or services linked from our platform.

9. LIMITATION OF LIABILITY

9.1 Exclusion of Damages

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TRIPKII SHALL NOT BE LIABLE FOR:

  • Any indirect, incidental, special, consequential, or punitive damages
  • Loss of profits, data, or goodwill

  • Personal injury or property damage related to your travel
  • Force majeure events (natural disasters, wars, strikes, etc.)

9.2 Maximum Liability

If we are found liable for any damages, our total liability shall not exceed the amount of any fees you paid to Tripkii in the 12 months preceding the claim.

9.3 Travel-Specific Limitations

We are specifically not liable for:

  • Flight delays, cancellations, or changes
  • Hotel overbookings or quality issues
  • Travel document or visa problems
  • Health or safety issues at destinations
  • Currency fluctuations or payment processing issues

10. INDEMNIFICATION

You agree to indemnify, defend, and hold harmless Tripkii, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from:

  • Your violation of these Terms
  • Your use of the Service
  • Your travel arrangements or actual travel
  • Any content you submit
  • Your violation of any third-party rights

11. PRIVACY AND DATA PROTECTION

Your use of our Service is also governed by our Privacy Policy. By using Tripkii, you consent to the collection and use of your information as described in our Privacy Policy.

12. DISPUTE RESOLUTION

12.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of Brazil, without regard to conflict of law principles.

12.2 Jurisdiction

Any disputes arising from these Terms or your use of the Service shall be resolved exclusively in the courts of São Paulo, Brazil.

12.3 Attempt to Resolve

Before initiating legal proceedings, you agree to attempt to resolve any dispute through good faith negotiation by contacting us at seletonurb@gmail.com.

13. ADVERTISING AND PROMOTIONS

16. SPECIFIC PROVISIONS FOR BRAZILIAN USERS

16.1 Consumer Protection

Brazilian users are entitled to the protections provided by the Brazilian Consumer Defense Code (Código de Defesa do Consumidor - CDC) to the extent applicable.

16.2 Language

These Terms are available in Portuguese. In case of conflict between versions, the Portuguese version shall prevail for Brazilian users.
